Sanam Tanks Terms and Conditions of Use

1. Introduction

These Terms and Conditions of Use govern the use of the Sanam Tanks app and services by Customers (individual consumers and businesses) and Drivers employed or contracted by businesses using our platform, outlining the practical rules including payment terms, delivery conditions, and liability limitations. By using the app, you agree to comply with and be bound by these terms.

Welcome to Sanam Tanks, operated by THE IDEAL COMMITTEE FOR ADMINISTRATIONAL CONSULTING CO., a company established and registered in the Hashemite Kingdom of Jordan and with its main address located at Abdul Wahab Al Majali, Shmeasani, 18111, JO, telephone +962 775959939. These Conditions and Terms of Use set the guidelines for accessing and using our liquid delivery services, whether you are an individual consumer or a business entity.

2. Acceptance of Terms

By downloading, accessing, or using Sanam Tanks you agree to be bound by these Terms and Conditions of Use. If you do not agree, you may not use our app. For businesses, you warrant that you have the authority to bind your organization to these terms. As a driver, you acknowledge that your enterprise-employer is also bound by separate terms and conditions with Sanam Tanks.

3. Scope of Use

Customer (B2C): You may use the app to order liquids for personal use within the available delivery areas.

Customer (B2B): Business users can place bulk orders for commercial use, subject to approval and licensing requirements where applicable.

Driver: The app is provided for Drivers to view and complete assigned deliveries, monitor delivery progress, and communicate with dispatch and recipients as needed.

4. User Conduct and Device Requirements

All users (both Customers and Drivers) agree to:

  • Use the app for lawful purposes only.
  • Refrain from uploading harmful or illegal content.
  • Not interfere with the app's functionality or other users' experience.
  • Drivers must ensure their mobile device is fully operational and location services are enabled while on duty. GPS tracking is required for order fulfillment and to verify delivery completion and is used according to our sanamtanks.com/privacy.

5. Account Registration

Customer (B2C): You are required to create an account with accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials.

Customer (B2B): Businesses must provide valid company information, including tax ID or business licenses if required. You agree to keep your business account information updated and secure.

Driver: Drivers must create an account in the app and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity on your account. Drivers must promptly notify Sanam Tanks of any unauthorized access or suspected security breach.

6. Order, Delivery Process and Driver Conduct

Customer (B2C): You may place orders for personal consumption, subject to availability and delivery area restrictions.

Customer (B2B): Business users can place bulk orders, and additional terms may apply for volume discounts or scheduled deliveries. Custom delivery times may be arranged with approval from Sanam Tanks.

Driver: As a Driver, you agree to:

  • Perform all deliveries responsibly, safely, and in accordance with applicable laws.
  • Confirm the identity of the recipient where required and verify delivery addresses.
  • Deliver items within the designated time windows.
  • Maintain a professional demeanor and appearance in interactions with recipients.
  • Notify the business of any issues that may delay delivery completion.

7. Delivery Conditions and Procedures

Customer (B2C): Deliveries are available within specific geographic areas. Delivery windows will be provided at the time of order, and users must be present to accept deliveries.

Customer (B2B): Businesses may arrange scheduled or recurring deliveries based on volume and location. Additional delivery fees or conditions may apply for large orders or special handling requirements.

Driver:

  • Order Management: Drivers are responsible for reviewing delivery details, confirming pickup, and updating status through the app.
  • Address Verification: Drivers must verify the address before delivery completion. Additional verifications or recipient identification may be required for certain items.
  • Customer Contact: Drivers should contact the recipient in case of delivery issues or delays.

8. Returns and Refunds

Customer (B2C): You may request a refund for defective or damaged goods within 7 days of receiving the order. Refunds will be processed within 14 days.

Customer (B2B): For bulk orders, businesses may return goods that are defective or not as described within a one week time frame. Custom orders may be non-returnable.

9. Incident Reporting and Support

Reporting Issues: Drivers must promptly report incidents, app malfunctions, or safety concerns to info@sanamtanks.com.

Support Services: For technical assistance, Drivers may contact our support team during business hours.

10. User-Generated Content

By submitting reviews, feedback, or other content, you grant Sanam Tanks a non-exclusive, royalty-free license to use, modify, and display such content. We reserve the right to remove any content that violates these terms. By doing so, you grant Sanam Tanks a non-exclusive, royalty-free license to use, modify, and display such content to improve our services.

11. Intellectual Property Rights

All content on Sanam Tanks (including text, images, logos, and trademarks) is owned by THE IDEAL COMMITTEE FOR ADMINISTRATIONAL CONSULTING CO. or our licensors. Users are not permitted to copy, modify, or distribute our content without express permission.

12. Privacy Policy and Data Collection

Your data is handled according to our Privacy Policy. We collect, store, and use personal and business information as needed to provide our services. For more details, visit sanamtanks.com/privacy.

Driver: Driver location and app usage data may be collected for service and performance tracking.

13. Disclaimer of Warranties and Limitation of Liability

Sanam Tanks is provided on an "as is" basis. We do not guarantee that the app will be error-free, uninterrupted, or meet specific user requirements. Use of the app is at your own risk.

Customer (B2C): Sanam Tanks is not liable for any indirect, incidental, or consequential damages resulting from the use of our app, including delays or errors in delivery.

Customer (B2B): Our liability for business users is limited to the value of the order placed, and we are not responsible for any loss of profits or business interruptions.

Driver: Sanam Tanks is not liable for damages related to Driver use of the app, including delays, loss of income, or issues arising from app errors.

In cases where a Driver experiences issues impacting their ability to work, they should contact their Business employer for resolution.

14. Termination

We reserve the right to terminate or suspend your account if you violate these Terms and Conditions of Use. You may also terminate your account at any time by contacting us at info@sanamtanks.com. Sanam Tanks reserves the right to terminate or suspend a Driver's account in cases of misconduct, non-compliance, or security concerns.

15. Changes to these Terms

We reserve the right to update these Terms and Conditions of Use at any time. Users will be notified of changes via in-app messages or email. Continued use of the app after changes means acceptance of the updated terms and conditions.

16. Governing Law

These Terms and Conditions of Use are governed by the laws of the Hashemite Kingdom of Jordan. Any disputes will be resolved under the jurisdiction of the courts in Amman, Jordan.

Welcome to Sanam Tanks application. Our terms and conditions govern both application organizers and users, which includes all content, functions, and services provided on or through the application.

By using the application, you confirm your unconditional agreement to adhere to these Terms and Conditions and your continued compliance thereof. In the event these terms and conditions are inconsistent with any other terms or guidelines for a particular service, these terms and conditions shall take precedence over all other regulations.

We reserve the right to revise these terms at any time by changing or amending this page, and your continued use of the application following the posting of any amendments to the application shall mean that you accept and agree to these amendments. The updated terms shall take precedence over all prior versions of the previous terms. Please check this page regularly to take note of any changes we have made, as you shall be obligated to adhere to them.

Your continued use of our application signifies your acceptance of these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use our application. If these Terms and Conditions are inconsistent with any other terms or guidelines for any service, the provisions of these Terms and Conditions shall take precedence over all other regulations.

Using the Application

Procedures

Each user must log in to the application and create an account. You can register using social media accounts such as Facebook, Google or email in addition to your mobile number. During login, we will collect information from you which will be used in accordance with the confidentiality and privacy policy upon request. The user can choose between delivery mode or self- service mode.

The user can enter his address on the map, or select one of his saved addresses, or search for a specific address.

The customer will see a variety of service providers according to each category in his area based on their availability. The customer must choose his preferred service provider from the list/ map to display the content of the service provider's list in order to choose from the items offered. Or the customer can click a specific request to send it to the selected service provider or to his other relevant commercial branches, or in the event of not selecting a service provider, the customer has to click on the specific request only to send it to the five nearest service providers.

The customer must specify distinctive features when choosing the delivery mode for accurate delivery, or he can choose a specific service provider from the category he chose, and fill out and send the request in which he asks for a price offer or (open the content of this service provider list, choose from it, add it and send it), in which case the system sends this order only to the specified service provider. In the event this service provider does not respond or the user rejects the price offer, the system will forward this user's request to the next service provider with the same brand name.

Each price offer sent to the customer shall include the price of the items, their tax value, if any, item pictures (if any), fees imposed (if any), service fee and description (if any), delivery time estimation or order processing, delivery expenses (if the user chose the delivery mode), accepted payment method(s), and price offer expiry date.

The user must carefully read the return policy of the service provider before accepting the price offer (Each service provider has his own return policy), and then select the payment method provided by the service provider in the offer.

The user can chat with the service provider upon accepting his price offer as long as the order is still open, and the chat will be closed once that order is closed automatically.

The user can use online payment, payment on receipt, or through the device upon receipt or use the wallet based on the payment method chosen.

The Service Provider shall not assign a delivery partner to deliver the user's order unless the user chooses the delivery mode for his order from the start.

The user can chat with the delivery partner (independent or online delivery partner), once the service provider assigns the delivery partner to deliver the order, as long as the order is still open. The chat is automatically closed once the order is closed.

Note: The user can enter into a group chat with the service provider and delivery partner to whom the order is assigned for delivery.

The delivery partner shall add any remaining "tips" to the user's wallet, if any, in the event that the payment is in cash upon delivery, in the event the customer approves this method by the delivery partner.

The user must rate the service provider and delivery partner, and each item the user has chosen from the service provider's list. In the event the items requested by the user were specific, such items will not be rated.

General Procedures

Users shall earn points based on their successful transactions in the application, and these points can be exchanged based on Wasfa campaigns that are applied periodically.

Credit or debit cards used when placing an order on the Wasfa Application must be the sole property of the user.

It shall be the user's full responsibility when placing an order with a debit/credit card after carefully reading all the terms and conditions.

Any items, equipment or anything that the user receives that is expired or does not match the order, Wasfa shall not be responsible and the responsibility lies solely with the vender. Therefore, the user must confirm the validity of the order when received and carefully read the service provider’s return policy before accepting the price offer submitted by the service provider.

Users can receive support by contacting Wasfa via live chat or through all available social media channels.

The user must be near the specified location at the estimated time of delivery. Delivery shall not be made to any location other than the location specified in the acceptable price offer.

The user must arrive at the specified location within a specified time period of his accepted offer, if the request is in self-service mode and during the service provider's working hours.

Users must keep their accounts secure, and no one else should use the account. Wasfa shall not be responsible for any error in the user's account due to its misuse by any other unauthorized party.

User can add a valid discount code based on the promotional regulations.

In the event of the user's absence from the address specified in the order during delivery, the items ordered by the user shall not be delivered to any other location.

The user shall accept the responsibility of placing an order to an address he is not available at.

Service Availability

Our Services may be modified, updated, interrupted, suspended, or discontinued at any time, at the Company's sole discretion, without notice or liability. The Service may be unavailable at certain periods, including but not limited to system failures, expected or unexpected maintenance work, upgrades, or due to force majeure.

We reserve the right, at any time, at our sole discretion, to modify, block, suspend or discontinue access to the Service, temporarily or permanently, in whole or in part, with or without notice as applicable to any user.

We shall not be liable for any kind of loss, liability or damage incurred as a result of any modification, suspension or discontinuance of the Service in whole or in part.

Use of the Service is subject to our Privacy Policy and Terms which are hereby incorporated into and made a part of these Terms of Use. Please review our Privacy Policy carefully. By using or accessing the Service, you agree to adhere to the terms of our Privacy Policy.

Usage Limits

The content in our application shall be used as a reference to service providers and is licensed and protected by the Jordanian copyright law, copyright laws, and international treaties and conventions.

Any trademarks, service marks, graphics, logos, page titles, icons, scripts, and trade names (each a “Trademark”) on the Application is our property or our licensors. Our trademark may not be used in connection with any product or service that is not owned by us in any way as this may confuse users or diminish the value of our products or anyone else's. All other trademarks not owned by us that appear on the application are the property of their respective owners.

Using our application

You can send us reviews, comments, photographs and other content or send messages, suggestions, ideas, questions or any other information, provided that such material is legal, non-obscene, threatening, defamatory, offensive, infringing intellectual property rights, harmful or otherwise unacceptable to any of the third parties and is not made of viruses or containing them, political campaigning, commercial solicitation, chain letters, or mass mailings. You may not use a false e-mail address, impersonate any other person, or otherwise mislead as to the origin of any content. We reserve the right to remove or edit any such content.

Transactions and Payments

Wasfa service providers support online debit/credit card payment options. Here you can find all the online payment methods that we offer in Jordan, as we support both MasterCard and Visa Card.

We hereby publicly disclaim any liability, injury, loss or damage, direct or indirect, of any kind, known and unknown, suspected or unsuspected, stated or undisclosed, arising out of or in any way related to any product sold by the vender through the services. By using the “Services”, you represent and expressly agree to release and hold harmless any products a customer purchases from any claim, demand, injury, loss or otherwise arising from any products the customer purchases and from any disputes between you and any user(s) of the services.

We shall make payment methods easier for the buyer through online payment. To be eligible to use the “Services”, you must sign in to and create an account using our platform, including providing all information required by such approved payment methods. You shall be responsible for adhering to all registration requirements with such Approved Payment Methods and otherwise complying with all the applicable terms and conditions of the Approved Payment Method.

Upon cancelling a payment by instructing your bank to return your funds and the bank complies, or if your provided bank account is no longer valid, you shall be liable for any penalty imposed on that bank or other payment options.

Where fees are entered in a currency different from the currency you are using, you accept all risk of any currency fluctuations, and undertake to pay the fees in full in our declared currency. You shall undertake to pay any tax that may arise due to the difference in currencies.

Third party applications

You should be aware that when you visit our Application, you may be directed to other applications that are outside of our control including links to or from affiliates and content partners who may use our trademark as part of an affiliate relationship. When you click on a link that directs you away from our Application, we may not control the application to which you are directed and different terms of use and privacy policies may apply which you should read and evaluate carefully. You acknowledge that we are not responsible for examining or evaluating, and we do not warrant the offers of any third party or the content of their applications.

We shall not be responsible for the actions, products or content of any third party or any third party application. We reserve the right to disable links to or from third party applications, although we are under no obligation to do so.

Notice

The information, content, products, services and materials available and provided by (Wasfa, you, other users or other affiliated parties/third parties) including but not limited to requests, submissions, texts, photographs, graphics, audio files, videos and links shall be “as is” and “as available” without warranties of any kind, explicit or implied, to the fullest extent permitted by the law. Wasfa disclaims all representations and warranties, explicit or implied, including but not limited to marketability guarantees, fitness for a particular purpose, ownership, non-infringement, virus free phone, and implied warranties arising from course of dealing or course of performance.

Return and refund policy

All service providers have individual return and refund policies. The return and refund policies of the service provider shall be included with the return policy information once the customer accepts the order.

Wasfa shall process any refund in your wallet within 2 business days, however, if you don't need the refund in your wallet, we can refund this amount back to your bank account.

The refund process varies depending on the payment method used.

Refunds for MasterCard and Visa may take up to 7 business days.

Compensation

You agree, at your own risk, to indemnify, defend and hold us, its employees, representatives, suppliers and agents harmless from any claim, act, or other action, to the extent based on or arising in connection with your use of the Service, or any links in the Service, including, not limited to:

  • Your use of the Service or the use of any person.
  • Violation of the terms by you or anyone using your device.
  • Claim that any use of the Service by you or anyone using your phone infringes any copyright, trademark or other intellectual property right of any third party, or any personal right, publicity, defamatory or other results in the event of injury or damage to any third party.
  • Any deletions, additions, insertions, modifications, or any unauthorized use of the Service by you or anyone using your device.
  • Any misrepresentation, breach of data, warranty or covenant made herein.
  • You agree to pay any and all costs, damages, expenses (including attorneys' fees), and costs awarded or incurred by or arising from any such claim, act, action, or proceeding.

Cancellation policy

You can request to amend any quotation sent to you 3 times before accepting it, however, please note that if you receive a quotation that has already been accepted by you and the service provider has already prepared your order or has appointed a delivery partner to deliver it, any additional items shall be counted as a new order. However, you can ask your service provider regarding everything you forgot via chat, and this shall be considered a new request.

The user can cancel his order at any time without any additional fees or penalty.

The user can cancel the accepted price offer at any time, but on each cancellation there is a penalty fee payable which will be automatically added to the next price offer for any new order the user makes.

Intellectual property

We are the owner and/or authorized user of all trademarks, trade names, service marks, design marks, patents, copyrights, database rights and all other intellectual property in or contained in the Application, unless otherwise expressly stated. Except as provided in these Terms, using the Application does not grant you any right, title, interest, or license to any intellectual property that you may access on the Application, except as provided in these Terms.

Any use or reproduction of intellectual property is strictly prohibited. Your use of the trademarks, service marks, or logos displayed on this Application, except as provided herein, is strictly prohibited.

Any license or right to use any trademark, service mark or logo displayed on this Application is expressly prohibited from being used without the prior written permission or prior written permission of such third party that may own the trademark, service mark or logo displayed on this Application.

Modifications

At our discretion, we reserve the right to change, modify, add or delete parts of these Terms and Conditions at any time without notice, and it shall be your responsibility to check these Terms and Conditions for any changes. Your use of the Application after any change to these Terms and Conditions will constitute your acceptance of the modified Terms and Conditions.

Governing law

These terms shall be governed and construed in accordance with the laws of the Arab Republic of Egypt. You agree that notwithstanding any statute or law to the contrary, any claim or cause of action arising out of or relating to the use of this Application or these Terms and Conditions must be brought within one year after such claim or cause of action arose. If any provision of the Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be applied to the fullest extent permitted and the other provisions shall remain in effect and full force.

Electronic communication

When you visit the Application or send us emails, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the Application. You agree that all agreements, notices and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Various legal provisions

We shall have the right discontinue the Application at any time for any reason, without notice.

We shall have the right to change the contents, operations, or features of the Application at any time, for any reason, and without notice.

You shall agree that no joint venture, partnership, employment or agency relationship exists between you and us as a result of these Terms and Conditions or your use of the Application. Nothing contained in these Terms and Conditions shall derogate from our right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Application or information provided to us or collected by us in connection with such use.

A printed copy of these Terms and Conditions and any notice given in electronic form in judicial or administrative proceedings based on or relating to these Terms and Conditions shall be permitted to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Our failure to enforce any provision of these Terms and Conditions or to respond to a breach by you or others does not constitute a waiver of our right to enforce any other provision of these Terms and Conditions with respect to such or any other breach.

If any provision of these Terms and Conditions is held to be invalid or unenforceable under applicable law, the remaining provisions shall continue in effect and full force, and the invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

These Terms and Conditions constitute the entire agreement between you and us relating to the Application and supersede any prior or contemporaneous agreement relating to such subject matter.
